Submission Guidelines
Images are prohibited from use in any form, such as layouts, sketches, xerography, or scanning, until the submission of an invoice and payment, indicating the Recipient's right to do so. This also applies to outright purchases of the images. No archiving, republishing, or transmission of images on any database is allowed without prior written consent from CREATIVE SERVICES.
Usage Terms
Unless stated otherwise, images remain the property of CREATIVE SERVICES or the specific contributor. The license granted upon payment is solely for the specified use outlined in the invoice. Recipients do not acquire any rights beyond the agreed use, and alterations to the images are not allowed without express written consent. Additional rights for re-use must be requested and paid for in advance.
Digital files are provided "as is," with no warranties. This agreement is non-assignable and non-transferable. All terms are contained in this contract, and any changes must be in writing and signed by both parties.
Payment is due within thirty days, with a service charge for late payments. Recipients must provide two free copies of the publication to CREATIVE SERVICES immediately upon printing.
Recipients retain rights when artwork is downloaded, but cancellations within ten days of download result in a 50% refund. After ten days, no refunds are provided.
Editorial use of images requires a credit line, and CREATIVE SERVICES reserves the right to charge a treble fee for use without credit.
All rights not granted to the Recipient are reserved for CREATIVE SERVICES's use. Recipients agree to be bound by these terms.
Limitation of Liability
CREATIVE SERVICES and image owners are not liable for direct, incidental, consequential, indirect, or punitive damages. The limit of liability is the fee paid for the artwork.
Recipients agree to indemnify CREATIVE SERVICES and the copyright holder from claims arising from image use or breach of the agreement.
Disputes or Claims
All disputes, except copyright claims, are to be settled by arbitration in New York, New York, under the rules of the American Arbitration Association. The agreement is interpreted under the laws of the State of New York.
If the Recipient operates in the U.S., disputes shall be adjudicated within the United States.
Copyright claims shall be brought in the Federal court with jurisdiction. Recipients are responsible for legal fees if CREATIVE SERVICES is forced to present claims or suits due to a breach of terms.
